Cayman appeal to dispel “cloud of doubt” over service

A Cayman court has allowed a Chinese conglomerate to pursue an “otherwise unmeritorious” appeal over a US$134 million HKIAC award, finding there was a public interest in dispelling doubt about the regime for service of ex parte orders for enforcement of foreign awards.

Cayman appeal court upholds injunction in aid of CIETAC arbitration

The Cayman Islands Court of Appeal has upheld an injunction restraining the enforcement of share charges pending a CIETAC arbitration – affirming there was no requirement to seek interim relief first from the arbitral tribunal or the courts at the seat of the arbitration.
