An international consortium including Italy’s Eni has lost an arbitration against the operator of a liquefied natural gas facility in Mississippi over a long-term contract allegedly frustrated by the shale gas revolution in the United States.

The Delaware Court of Chancery has enjoined a subsidiary of Italian energy company Eni from pursuing part of its claims in a new ICDR case against the operator of an LNG import terminal – holding that it amounted to a “collateral attack” on a US$371 million award rendered in a prior arbitration.
