Indian Supreme Court frowns on unilateral arbitrator appointment

A constitutional bench of the Supreme Court of India has held that for one side of a dispute to limit the other’s scope to appoint an arbitrator of their choosing through unilateral decision-making is against the principle of equal treatment of parties and the Indian Constitution and could give rise to bias.
