US appeals court refuses discovery for ICSID dispute

A US appeals court has refused to reinstate discovery orders obtained by an Italian construction group for its US$2.2 billion investment treaty dispute against Panama, upholding an earlier ruling that the country’s courts have no power to order discovery in aid of ICSID arbitrations.
