Hong Kong court blocks mainland award over arbitrator’s lack of focus

A Hong Kong court has refused to enforce a mainland Chinese arbitration award because of the conduct of an arbitrator who took part in a hearing remotely while “wandering around” in public places and adjusting his seatbelt in the front seat of a car.

ICCA taskforce concludes study on right to physical hearing

An ICCA taskforce has wrapped up its investigation into parties’ right to a physical hearing in international arbitration, finding that none of the 78 jurisdictions examined expressly guarantee this and courts are unlikely to set aside awards solely based on proceedings having been conducted virtually.
